Agreement to Terms

By accessing or using the Altacap website and services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use our services.

These Terms apply to all visitors, users, and others who access or use our services, including customers purchasing custom headwear products.

Product Orders and Services

Order Process

• Orders are subject to acceptance at our discretion
• All orders require a valid quote and design approval before production begins
• Custom orders are final once production has started
• We reserve the right to cancel any order for any reason

Minimum Orders

Minimum order quantities vary by product and decoration method:

• Direct embroidery: 6 pieces minimum
• Patches and custom designs: 12-24 pieces minimum (varies by type)
• Special order products may have higher minimums

Product Descriptions

We strive to ensure all product descriptions and images are accurate. However, we do not warrant that descriptions are error-free, complete, or current. All colors shown are approximations and may vary due to manufacturing processes.

Pricing and Payment

Pricing

• All prices are in USD unless otherwise stated
• Prices are subject to change without notice
• Custom quotes are valid for 30 days
• Rush order fees may apply for expedited production

Payment Terms

• Payment is required before production begins
• We accept major credit cards, PayPal, and ACH transfers
• Net 30 terms available for approved business accounts
• A 50% deposit may be required for large orders over $5,000

Taxes and Fees

Applicable sales tax will be added to your order based on your shipping location. Shipping fees are calculated based on order weight and destination.

Shipping and Delivery

Production Time

• Standard production: 10-15 business days after artwork approval
• Rush orders: 5-7 business days (additional fees apply)
• Production times exclude weekends and holidays

Delivery

• Delivery times are estimates and not guaranteed
• We are not responsible for delays caused by shipping carriers
• Risk of loss transfers to you upon delivery to the carrier
• You are responsible for providing accurate delivery addresses

Returns and Refunds

Custom Products

Custom-decorated products are final sale and not eligible for returns, exchanges, or refunds except in cases of manufacturing defects or errors on our part.

Quality Guarantee

• We guarantee products free from manufacturing defects
• Quality issues must be reported within 7 days of delivery
• We will replace defective items at no additional cost
• Proof of defect may be required (photos, samples)

Non-Custom Products

Stock items without customization may be returned within 30 days in unused condition, subject to a 15% restocking fee.

Intellectual Property

Customer Artwork

• You represent that you own all rights to artwork provided
• You grant us license to reproduce your artwork for order fulfillment
• You indemnify us against any intellectual property claims
• We reserve the right to refuse artwork that infringes copyrights or trademarks

Our Content

All website content, including text, graphics, logos, and images, is owned by Altacap or our licensors and protected by copyright laws.

Limitation of Liability

To the maximum extent permitted by law, Altacap shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services.

Our total liability for any claim shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our control, including but not limited to acts of God, war, terrorism, government action, labor disputes, or material shortages.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services constitutes acceptance of the revised Terms.
